General terms and conditions


1. Identity of the entrepreneur:
The webshop GSM PLUS MARKET.COM/.NET is a part of our case Home and Health Care Products and has its registered office at 9170 Sint-Gillis-Waas, Nieuwstraat 57 to Belgium and is registered in the kruispuntbank der Ondernemingen (KBO) under the number 0788.024.436 in the name of Wim Ysewijn with the associated VAT number BE 0788.024.436.
The activities covered by the principle of "sales at a distance" that governs the terms and conditions as follows: The customer confirms that he/she is at the time of purchase has taken notice of these sales conditions and declares itself without any reserve agree. For all legal relationships between the webshop GSM PLUS MARKET.COM/.JUST on the one hand, and the customer on the other hand, apply the following provisions unless expressly and in writing another agreement was concluded.


2. Application
Each order shall be deemed acceptance by the Buyer of our general terms and conditions, which form an integral part of the agreement, to the exclusion of all other General or special conditions on the basis of the Buyer, unless explicitly written different circumstances.


3. Tenders and acceptance of the order
All our offers are without obligation. The information about the products and prices, as well as the detailed order information, are drawn up and notified via email or fax. After written acceptance by the customer of this order information and any advance payment of an advance payment or the whole amount of the order will be executed.


4. Delivery
The delivery of the products happens after receipt of the payment of the order. For Belgium and Netherlands are delivered after 1 business day after receipt of payment by the Buyer. We are not responsible for any delay by the national postal services of Belgium and the Netherlands respectively Bpost and TNT Post. Products will only be delivered in the countries for which the website allows the delivery. Incorrect delivery addresses are passed on the responsibility of the purchaser and may result in additional costs.
Subject to different circumstances our prices do not include the delivery of the goods to the Buyer. The cost of the delivery are given separately.
The stated delivery dates via email, SMS or fax are not binding, but are merely given as an indication. No delay in delivery may result in cancellation of the sale or payment of damages for the benefit of the Buyer, except in cases of intentional delay.
We also have the right to carry out partial deliveries.
In case of non-delivery of the goods, any sums paid by the purchaser refunded without interest or other compensation.


5. retention of title
The delivered goods remain our property until full payment of the price, including all fees and charges, overdue and fees. In the event of non-payment we reserve the right to take the goods back, by law at the expense of the Buyer.


6. Complaints
Complaints must, to be admissible, allow us to: (a) in case of complaint for non-conforming delivery, fourteen (14) calendar days after delivery and (b) in case of hidden defects, fourteen (14) calendar days after discovery of the defect or after the time when such discovery should reasonably be able to happen.


7. Guarantee
Our guarantee (guarantee) includes the guarantee of hidden defects and the guarantee in the event of consumer sale, both provided in the civil code.
We are not liable for any general or special indirect damages, of any nature whatsoever, suffered by the Buyer.


8. right of cancellation
In the framework of the distance selling to consumers within the scope of the law of 14 July 1991:
the consumer is entitled to withdraw from the purchase, without penalty and without giving any reason within the ten (10) working days from the day following the delivery. 9. force majeure
We are not liable for a delay in the implementation or for a non-performance of our obligations because of events beyond our normal control, included production interruptions, difficulties in supply or shortages of raw materials, labour, energy or transport or delays in transportation, strikes, lock-outs, work stoppage or other collective labour disputes, which either ourselves or our suppliers hit, and this even if these events are predictable.
